A Dog Wins Against the Anti-Pitbull Policy of a Subdivision in Cebu City

A lawyer helps a dog in Cebu City to win a case against the subdivision that has an anti-pitbull policy.

A lawyer by the name of Atty Ben Cabrido Jr. helped Kimbo, an American Bully dog, who is facing a complaint before Cebu City’s Regional Trial Court Branch 18. On November 30, 2022, Attorney Cabrido posted a story about his American Bully client, who had prevailed in a lawsuit against a development, on his Facebook page.

Atty. Cabrido, apart from being a practicing lawyer, is an environmental law professor and legal consultant on matters related to the environment. He vehemently defended the dog’s right to stay with his human family, despite their subdivision’s anti-pitbull ban, according to his post.

“This is Kimbo, our American Bully client. In the dog injunction case heard before the Regional Trial Court Branch 18 of Cebu City in the last quarter of 2018, Atty. Dulhao and I argued passionately for his right to be with his human family despite their subdivision’s anti-pitbull policy,” he said.

“And he won,” he shared.

The attorney did not mention the subdivision where Kimbo’s fur parents reside in. Atty Cabrido shared a portion of the ruling stating the requirements in the agreements that only “cattle, pigs, lambs, carabaos or horses and their comparable class” are prohibited in subdivision properties.

It’s claimed that Kimbo is a domesticated pet and is not a pig or a cow. A rule banning the ownership of a specific breed of dog is also not something the subdivision is allowed to implement.

Internet users responded favorably to Kimbo’s case’s resolution. Many people have asserted that a dog’s level of aggression is influenced by how its owners treat it, regardless of breed.

They also explained Kimbo’s breed is not dangerous. Some dog-loving internet users claim that American Bullies are “friendly and exceptionally intelligent” canines.

Because of its bravery, good temperament, and lack of aggression, it makes a good guard dog. This breed values socialization, so owners are advised to introduce it to a variety of people and animals while it is still a puppy so that it can get used to interacting with others.
