Lawyer Elaborates Charges That Can Be Filed Against Gossipers
A lawyer gives an advice to the public regarding the charges that can be filed against gossipers or Chismosang Kamag-Anak’.
LDW Vale, a follower of the program “Sumbungan ng Bayan” sought help and asked the expert’s suggestion regarding the charges that can be filed against its gossiper relative who even threatened her life.
Atty. Zen Ferrer said that the complainant can file charges of grave threat to the suspect. The lawyer explained that Vale can also file charges of unjust vexation against the gossiper for its irresponsible act.
“Kung araw-araw ka na lang tsini-chismis at kung anu-ano yung nadidinig mo sa iyong kapitbahay o kabarangay na nagiging reaksyon nila sa pagchismis nung [kamag-anak]…at naapektuhan na ang iyong pag-iisip at pang-araw araw na buhay, nababalisa na kayo dahil sa pinagsasabi ng ibang tao, puwede po ito ulit na unjust vexation,” Ferrer said.
Ferrer said that gossipers can face oral defamation or slander if caught spreading rumors containing negative information against the victim. The Supreme Court does not require many witnesses as long as someone learned and can prove the ‘Chismis’ has been publicized.
Attorney Irene Pua of Ideals Inc. said that involved individuals can settle the issue at the barangay hall before taking the issue to the higher court and hiring a prosecutor. She said that the law is trying to reconcile the involved individulas.
If the reconciliation fails, the complainant can already bring the matter to the higher court for filing of charges.
