The Department of Labor and Employment has issued the holiday pay rules for Eid’l Adha, which is a regular holiday.

President Rodrigo Duterte has declared July 31, 2020 (Friday) as a regular holiday in observance of Eid’l Adha through Proclamation 985. The holiday declaration aims to give our Muslim countrymen the full opportunity to participate in the activities.

Recently, The Labor Department has reminded the employers regarding the pay rules during the Muslim holiday “Eid’l Adha”. DOLE also gave employers the choice to defer the payment until the normal business operations are resumed.

Holiday Pay Rule

DOLE said that workers who will report for work during the holiday shall receive 200 percent of its daily salary for the first eight hours. The employees shall also receive an additional 30 percent of their holiday rate if they worked overtime.

If the employee did not report on his/her duty during the holiday, he/she is entitled to receive 100 percent of its basic wage.

Workers who will report to work during the holiday that also fell on their rest day shall receive an additional 30 percent of their hourly rate.

“The Labor Advisory, however, stipulates that some companies may defer the payment of the holiday pay until such time that the national health emergency arising from COVID-19 (coronavirus disease-2019) is abated and normal business operations are resumed,” DOLE said on the statement.
