Companies Who Fail to Provide 13th Month Pay May Loses their Business Permit

House of Representatives is now proposing a bill aimed at canceling the business permit of companies who fail to provide employees the 13th-month pay.

13th month pay is a form of cash benefit equal to the monthly basic wage an employee receives under Presidential Decree 851. 13th month pay is usually given within the month of December.

Meanwhile, according to the report of Radyo Todo, Under House Bill 6272 filed by ACT-CIS Partylist Reps. Jocelyn Tulfo, Eric Yap and Niña Taduran, will require all companies and businesses to submit their compliance reports for providing 13th month pay.

This, in turn, will form the basis of a review of all regional offices of the Department of Labor and Employment in such companies. In the event of any deficiencies in the compliance report, companies will be given five days to explain.

If any violations are found, their business permits will be canceled. Financially distressed employers who cannot afford to pay 13th month pay are exempted from this proposal.
