Senator “Bato” Dela Rosa Admits GCTA Law Is Ambiguous & Unclear

RONALD BATO DELA ROSA – Senator “Bato” Dela Rosa gave his take on the Good Conduct Time Allowance (GCTA) law controversy, which according to him, was ambiguous and unclear.

During an Interview with ANC, Senator Dela Rosa was questioned about his 6 month run as Bureau Of Corrections (BuCor) Chief. He then stated that even lawmakers admit there is ambiguity in the GCTA law.

“The IRR (Implementing Rules and Regulations) is not clear, the law nga mismo hindi clear eh”, said Dela Rosa. Furthermore, the senator added that there is no harmony between sections one and three in the GCTA law.

According to Dela Rosa, section 1 stated that heinous crime convicts are not eligible for the GCTA. However, section 3 stated that every convict is eligible to benefit from the law.

Continuing with the interview, the Senator said that law makers are only basing the Implementing Rules and Regulations (IRR) on the law. Likewise, implementers of the law based their judgement on the IRR.

The Senator then proceeds to lament on why all the blame is placed on the implementer and not the lawmakers. Dela Rosa then added that he is merely following the law.

As the interview progressed, he was asked about the process on how convicts were given to him in terms of the GCTA. Senator Bato Dela Rosa then mentioned the different steps required for a document to reach him.

Dela Rosa explained that before getting to him, the inmate document processing section computes for the GCTA. The computations are based on an evaluation monitoring committee composed of the warden and his group, he added.

In the interview he was also asked if he had investigated Ramoncito Roque during his run in BuCor. Senator Bato said yes, although no evidence was found against Roque.
