Human Rights Lawyers Says Re-Arrest Order For Released Convicts Must From Court

RELEASED GCTA CONVICTS – Human Rights lawyers said the re-arrest order of the released heinous crimes convicts under the GCTA law must come from the court and not the government.

Last week, President Duterte gave an order to the PNP to re-capture the released heinous crimes convicts should they fail to surrender themselves under 15 days. As of Sunday, there had been at least 118 convicts that have surrendered.

Rene Saguisag, a former senator stated that there was no lawful justification to the re-arrest order. He added that authorities need to get an order from the court to arrest anybody.

According to a video from ANC’s Early Edition, he stated that only in martial law could a president deprive the liberty of any individual. Erin Tañada then added that it’s not the executive branch to determine that, but the court of jurisdiction.

Free Legal Assistance Group lawyer, Erin Tañada then stated that it’s the court who interprets the law. He added that the administration has to go to court to get that interpretation before they could start the re-arrests.

Saguisag then said that no one should be obligated to surrender because the presumption is that the law was followed. He stated that the government should review the cases before they re-arrest.

Former senator Saguisag also said that these are not fugitives, they’re released convicts. He added that If there were sudden spikes of released convicts in certain years after the GCTA implementation, the government should look into that.

According to the Bureau of Corrections, there had been a total of 2,160 heinous crimes convicts released early under the GCTA law.
