SC Upholds Napoles Indictment On PDAF Scam

The Supreme Court trashes further pleas of businesswoman Janet Lim Napoles for dismissal of several cases filed against her before the Sandiganbayan.

The Philippine Supreme Court upheld the filing of cases before the Sandiganbayan against the alleged mastermind in the Priority Development Assistance Fund (PDAF) scam, Janet Lim Napoles, in connection to the anomalous disbursement of the pork barrel allocations of Fomer Congressmen Constantino Jaraula of Cagayan de Oro City and Samuel Dangwa of Benguet.

In the complaints before the Office of the Ombudsman, over P50.5 million PDAF allocations of Jaraula from 2004 to 2007 were allegedly anomalously disbursed through bogus non governmental organizations (NGOs) of Napoles.

Napoles allegedly created NGOs that were used in the diversion of pork barrel.

While Dangwa’s pork barrel amounting to P54 million released in 2004 and 2007 were used in the same way.

In the Supreme Court decision, it was found that there was no grave abuse of discretion on the part of the Ombudsman and Sandiganbayan when they declared that there was probable cause to litigate Napoles in the court.

Napoles faces charges on graft, malversation of public funds and corruption of public officers because of the anomalous disbursement of PDAF of both Dangwa and Jaraula.
