November 1 & 2, 2013 Holiday Pay Rules by DOLE

The Department of Labor and Employment reminded employers to follow the strict regulations of the Philippine government in observance of the November 1 and November 2 Special Non-Working Holidays.

The Special non-working holiday means that the no-work, no-pay policy is applied, the declaration of November 1 and 2 as special (non-working) holiday is to allow Filipinos to remember and honor their dearly departed family members and love ones.

By virtue of the implementing guidelines for Proclamation Proclamation No. 459, s. 2012declaring the regular holidays, special (non-working) days, and special holiday for the 2013. DOLE based the pay rules from the declaration of Holidays.

Here’s the November 1 & 2 Holiday Pay Rules as approved by DOLE:

  1. If unworked
    • No pay, unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment of wages on special days even if unworked.
  2. If worked
    • 1st 8 hours – plus 30% of the daily rate of 100%
    • excess of 8 hours – plus 30% of hourly rate on said day
  3. Falling on the employee’s rest day and if worked
    • 1st 8 hours – plus 50% of the daily rate of 100%
    • excess of 8 hours – plus 30% of hourly rate on said day
