DOLE Released Guidelines for 13th Month Pay

The Department of Labor and Employment issued a guideline on Monday, November 19, a Department Advisory No. 2 Series of 2012, which (–foul word(s) removed–)ured the Filipino workers that they will receive their 13th month pay on or before Christmas Eve.

According to DOLE Guidelines, all the wage and salary workers are entitled to receive their 13th month pay, as mandated by law referring to Presidential Decree No. 851 (P.D. 851) which is equivalent to one twelfth (1/12) of their basic salary within a calendar year.

The advisory also released the guidelines and formula as well as the computation of the 13th month pay. The agency also clarified that the 13th month pay does not include allowances and monetary benefits as part of the basic salary.

  1. My friend is a former manager of a cooperative in Palawan, Philippines.

    He resigned after serving 7 months. It has been the practice of the cooperative to give 13th month pay to all employees including managerial position. Recently, an officer of the cooperative questioned the computation of 13th month pay for the resigned manager which is due to be given this December.

    Is the resigned manager still entitled to the 13th month pay?

  2. Mag inquire lng po, kmi po ng asawa ko is working in government agency as JOB ORDER, at no employeer employee relatioship. Tanong ko lng are we covered po ba ng 13th month pay kc ever since never pa kmi nkatanggap ng 13th month pay o anumang bunos 4years na po ako s work at 3 years n din ung husband ko.

  3. I am working with a private construction company here in the Philippines. Recently, I receive my 13th moth pay in which it is less than I expected. I asked our accounting department and I have learned that they are treating the 13th month computation as pro-rated to our attendance. Meaning they are also deducting our previous absences from the 13th month pay. Is this allowed by our governing employment laws?

    • Yes the computation of the 13th month pay is based on your attendance.
      example: P12,000 monthly salary; 12,000/12months = 1,000/month.
      if your total attendance will equate to 11.5 months, you will be given 11,500 as 13th month pay.
      if you only work for 6 months, you will only get 6,ooo given the above example

  4. Ako po ay nagtatrabaho bilang adsl & telephone technician for almost
    5yrs. Ngaun po ako napagbintangan kmi at tinanggal sa trabaho nung
    oct. 29 2013.Gayung ala aman clang ibidensya. Tanung ko po kng may makuha pa kming 13th mńth sa kabila ng nangyari. Sana matulungan nyo kmi.

  5. Mgttanung lang po 10 yrs na po akong gwardya sa aming agency. 12 hrs po duty ko in 7 days a week.binabayaran po kmi ng overtime pro kaparehas lng ng reg. Hr. Na dapat ay times.30% ayon sa dole. At pgdating po sa 13 month. 8 hours lng ang kinocompute nla samntalang 12 hrs po ang duty k in whole yr round. Kung susumahin po sampong taob n kmi ninanakwan ng agency may praan b mbawi ko po un ninakaw nla sa akin. Sana po mtulungan nyo ako

  6. Parehas po kmi ni sg macabodbod ng problema sapagkat iisa po ang agency nmin. Sana po ay mtulungan ninyo kmi. Dagdag pa po jn hindi po nmin mkkuha ang 13 months pay nmin kung hindi ma renew ang mga requirements nmin samantalang 14 yrs n ako sa agency nsa batas po b na dapat lagi bago ang Nbi police at barangay clearance khit reg k sa agency.   7. I was hired last march 26, 2012 & Im planning to resigned this coming april 2015, I get my 13th month pay last december. My question is can I still avail my 13th month pay early this year for the month of january-april only when I resigned?

  8. just wanna ask po private teacher po ako ung computation po ng employer ko SA 13th month pay at ganito basic salary (8000)x 10months po..tama po ba UN? KC sabi nya 10months lang daw ung work namin from may to March..
